1. Introduction
Welcome to TallyBoat! TallyBoat is operated and owned by TallyBoat L.P. Company. By accessing or using our platform, you agree to comply with and be bound by these Terms of Service. If you do not agree, please refrain from using the platform.
By using TallyBoat, you acknowledge that:
- TallyBoat is a work environment where users upload, manage, and share content at their own discretion.
- Users are responsible for their own content and the data they process.
- TallyBoat acts as a technology provider and is not responsible for content shared within the platform or transactions between users.
- User Responsibility: Users are responsible for the security of personal data they upload or share on the platform.
- TallyBoat does not actively monitor or review user-uploaded content. Users are solely responsible for ensuring that any content they upload complies with applicable laws and does not violate third-party rights.
2. User Accounts
- Registration: Users must provide accurate information when registering and are responsible for maintaining the confidentiality of their login credentials.
- User Types: Users may register as boat owners, operators, crew staff, crew members, or suppliers.
- Account Changes: Users can switch between different account types depending on their role and needs.
- Fees: While basic registration is free, subscription tiers are based on the number of boats and services used.
3. Service Modifications and Termination
- Changes: TallyBoat may modify the platform’s features or terms, providing users with reasonable notice of any significant changes.
- Termination: Accounts may be suspended or terminated if the terms are breached or unlawful activity is detected.
4. Platform Use
- Lawful Use: Users agree to use the platform for legitimate purposes according to the intended purposes of TallyBoat and not engage in any activities that may harm or interfere with other users.
- Intellectual Property: All content and features on the platform, including software, are the property of TallyBoat and protected under copyright laws.
- User Content:
- TallyBoat ensures that any copyrighted material uploaded by users is protected.
- Users retain ownership of any content they upload at all times but grant TallyBoat a non-exclusive license to use, modify, and distribute the content within the platform.
- Users must ensure they have the rights to any content they upload to the platform.
5. Illegal Content and Prohibited Behavior
5.1. Prohibited Content
TallyBoat is committed to maintaining a safe and lawful environment for all users. Users must adhere to the following guidelines regarding illegal content and prohibited behavior. TallyBoat does not actively monitor or verify content uploaded by users. Users are responsible for ensuring that their content complies with applicable laws.
By using the platform, you agree not to engage in or upload any content that:
- Hate Speech: Promotes violence or hatred based on race, ethnicity, religion, disability, gender, age, nationality, sexual orientation, or gender identity.
- Fake Information and Fraud:
- Fraudulent listings, transactions, or claims regarding boats, services, or products.
- Fake documentation or credentials.
- Counterfeit Products: Selling, promoting, or distributing counterfeit goods, including products that infringe on trademarks or patents.
- Privacy Violations:
- Sharing personal information without consent.
- Unauthorized access to or sharing of private data, including email addresses, phone numbers, and financial information.
- Illegal Activities: Violations of local, national, or international laws, including but not limited to:
- Human trafficking or exploitation.
- Promotion of illegal substances or services.
- Cybercrimes such as hacking, phishing, or distributing malware.
- Harassment and Abuse: Threats, harassment, or abusive behavior, including cyberbullying and stalking.
- Intellectual Property Infringement: Unauthorized use of copyrighted material, trademarks, or patents.
- Child Exploitation: Any content that exploits or endangers children.
- Terrorism and Extremism: Content that supports or promotes terrorist activities or violent extremism.
5.2. Violations & Consequences
Users who violate these rules may face the following actions:
- Content Removal: Illegal or prohibited content will be removed.
- Account Suspension or Termination: Depending on the severity of violations, accounts may be temporarily suspended or permanently terminated.
- Legal Action: In cases of illegal activities, TallyBoat may report the user to relevant authorities.
If you encounter content that violates these rules, please report it using the platform’s content reporting tool.
6. Content Moderation and Notice-and-Action Mechanism
- Content Responsibility: Users are responsible for the content they upload to the platform (including boat listings, maintenance records, and transaction details). By using TallyBoat, users agree not to upload illegal content or infringe on third-party rights.
- Illegal Content Reporting: Users can report content they believe violates laws or platform policies using the designated content reporting tools. TallyBoat will review and take appropriate action.
- Notice-and-Action Mechanism: If TallyBoat receives a notice regarding potentially illegal content, we will assess the claim, notify the user, and take appropriate action (removal, restriction, or other necessary measures).
7. Transparency of Terms and Conditions
- TallyBoat ensures transparency in how content is moderated. Users will be informed of decisions regarding content removal or account suspension.
- TallyBoat’s ToS clearly outline prohibited content, including illegal material, copyright violations, and fraudulent information.
8. Dispute Resolution and User Redress
- Appeals: Users may appeal decisions related to content removal or account suspension.
- External Dispute Resolution: Users may escalate complaints to an out-of-court dispute settlement body certified under the Digital Services Act (DSA).
9. Direct Dispute Resolution Among Users
TallyBoat provides an internal Direct Dispute Resolution System to help users resolve conflicts efficiently without third-party intervention.
Process
- Initiating a Dispute: Users can submit a dispute through TallyBoat’s resolution portal.
- Structured Communication: Secure discussion space for users to present concerns and evidence.
- Resolution Agreement: Once an agreement is reached, it is documented within the platform.
- Transparency & Record-Keeping: All dispute records are securely stored.

10. Accountability for Professional Users
Professional users (e.g., suppliers, boat owners, operators, or crew) offering services or products must provide clear business information, duty holders, and customer support details.
11. Liability Disclaimer
- TallyBoat is a neutral technology provider and is not liable for user-generated content or transactions.
- TallyBoat provides its platform on an “as-is” and “as-available” basis. We make no warranties regarding uninterrupted access, security, or suitability for any purpose. Users assume full responsibility for their use of the platform.
12. Jurisdiction
These Terms of Service are governed by the laws of Greece and the European Union. Any disputes shall be subject to the jurisdiction of the courts of Athens, Greece.
